Terminology and Definitions 

Abode Home: Lessor.  A Lessor is an entity, Abode Home, who transfers the right to possession and use of goods owned by that entity pursuant to a lease.

Customer: Lessee.  A Lessee or Customer means a person who acquires the right to possession and use of goods under a lease agreement. 

Rental, lease, and subscription are interchangeable terms and mean Abode Home/Lessor’s transfer of possessory interests in property to the Customer/Lessee in exchange for the payment of rent money from the Customer/Lessee, according to and subject to this agreement. Ownership of the property remains with Abode Home during a rental, lease, or subscription. 

Service Area: This means the area within a 50-mile radius of the Abode Home warehouse location that is closest to Customer’s geographic location where the item(s) and property will be used by Customer.

Order Summary: This is the document provided upon checkout which contains additional information, terms of the rental agreement, and a summary of Customer’s completed order. 

Item(s) and Property: These terms are used interchangeably and include the goods owned by Abode Home that are subject to rental/subscription by Customer and includes furniture, housewares, accessories, décor, lighting, and appliances.

TERMS

Abode Home and Customer agree that: Abode Home rents to Customer and, Customer rents from Abode Home, the items listed on the Order Summary. The rental term selected by the Customer begins on the day the items listed on the Order Summary are delivered. 

Item Condition: No item(s) are guaranteed to be new.

Package Rental: It is understood that complete Package Rental transactions are a lease and not a lease/purchase agreement, conditional sale, or financing agreement. Title to and ownership of each item of the Package Rental shall remain with Abode Home, and the Customer shall not grant a security interest of any kind in any item and shall not dispose of any item of the Package Rental. The minimum rental period for the Package Rental agreement is two months.  Customer is not obligated in any way to renew this Package Rental agreement after the initial rental period.  Customer may renew this Package Rental agreement if Customer has complied with its terms by continuing to pay monthly payments to Abode Home before the end of the current rental period. Customer understands this Package Rental agreement terminates automatically if Customer does not renew it and the balance on Customer’s account is paid in full. Customer does not have the right to a refund of any rental payments if this agreement is terminated. Customer acquires no equity interest in the property, regardless of rental type, while renting.     

No Commitment Item Rental: It is understood that No Commitment Item Rental transactions are a lease and not a lease/purchase agreement, conditional sale, or financing agreement. Title to and ownership of each item shall remain with Abode Home and the Customer shall not grant a security interest of any kind in any item and shall not dispose of any item. Customer is not obligated in any way to renew this No Commitment Item Rental agreement after the initial rental period. Customer may renew this No Commitment Item Rental agreement if Customer has complied with its terms by continuing to pay monthly payments to Abode Home before the end of the current rental period. Customer understands this No Commitment Item Rental agreement terminates automatically if Customer does not renew it and the balance on Customer’s account is paid in full. Customer does not have the right to a refund of any rental payments if this agreement is terminated. Customer acquires no equity interest in the property, regardless of rental type, while renting.  

Item Rental: Item Rental transactions are lease/purchase agreements.  Customer agrees to pay all monthly rental payments for the term selected by the Customer. The initial payment will be collected upon the confirmation of order. This initial payment will consummate the agreement, and delivery will be made on the day confirmed in the Order Summary by Abode Home after receipt of the initial payment.  Customer’s next rental payment will be due one month after delivery and will continue monthly until the end of Customer’s rental term as stated on the Order Summary. At the end of Customer’s selected rental term, Customer has three options: 1. Select a new rental term and continue monthly payments. 2. Provide Abode Home a 10-day notice to schedule pickup prior to the expiration of the rental term. 3. If the Customer has complied with the terms of this agreement, Customer may choose to purchase the property at any time. The purchase price of the item(s) will be computed as follows: Retail price of the item(s) as listed on the Customers Order Summary less the total amount of rental payments made. If Customer wishes to continue their subscription but fails to select one of the three options above, the rental term will renew month to month at the original term rate as stated on the Order Summary. In the event the total amount of rental payments reaches the retail price listed on the Order Summary and all Other Fees, as outlined in this agreement and as applicable, have been paid, monthly payments will stop, and ownership will transfer to Customer. Customer does not have the right to a refund of any rental payments if this agreement is terminated. Customer acquires no equity interest in the property, regardless of rental type, while renting.

OTHER FEES

LATE FEES:  If Customer does not make a rental payment within 7 days of the due date, Customer will be charged a late fee of $5 for each late rental payment. 

RETURNED CHECK FEE: If Customer writes a bad check, Customer will be charged a fee of $25 plus any legal and bank fees incurred by Lessor.

ADDITIONAL TRIPS: 

  1. Exchanges made within 7 days of the original delivery date are provided at no cost to the Customer as part of our customer satisfaction guarantee.
  2. Additional deliveries, exchanges, or partial pickups made by Abode Home, excluding the initial delivery and final pick-up, will be charged a fee that will not exceed the original delivery fee on the Customer’s Order Summary. 
  • Moving Fee:
    • If Customer moves within our service area, Abode Home will move the items Customer is currently renting from Abode Home when provided with a minimum of a 10-day notice. The move fee will not exceed the amount of the delivery fee on the Customer’s original Order Summary. Customer agrees not to move items as stated in “Use of Furniture” section of this agreement.
    • If Customer is moving outside Abode Home service area, the Customer must notify Abode Home at least 10 days prior to moving.  For “Lease” options, the items will be picked up and the lease will terminate once the balance on the account is paid in full.  For “Lease/Purchase” options, the Customer has the option to purchase the items as explained in section 1.b of “Ownership Options”.  If Customer chooses to return items to Abode Home prior to the end of the stated term, Customer will owe any amounts due as explained in the “Early Termination by Customer” section.
  • Unauthorized Moves: Customer must provide to Abode Home a minimum of 10-days’ notice of any move of the items. Any unauthorized move of item(s) may result in a fee equal to the amount of the delivery fee on the Customer’s original Order Summary.

CUSTOMER PROTECTION PLAN: Customer is liable for the retail price of the item(s) if they are lost, stolen, damaged, or destroyed. In lieu of property damage insurance, Customer may choose to pay Abode Home a Customer Protection Plan fee of 10%* of their monthly rental rate for the duration of the lease. Abode Home shall bear all risk of damage or destruction for the leased property from any cause, except the following, which shall be the responsibility of the Customer:  a) any intentional, malicious, willful act, or omission of Customer; b) Customer’s failure to exercise due care relative to said property; c) any damage caused by cigar or cigarette burns, pets, and insect infestation; or d) the mysterious disappearance or theft of the property. *(8% for Nebraska Residents) 

Texas Residents: For Item Rental Lease/Purchases, this agreement offers an optional loss damage waiver for an additional charge to cover your responsibility for loss of or damage to the merchandise You do not have to purchase this coverage. Before deciding whether or not to purchase this loss damage waiver, you may consider whether your homeowners’ or casualty insurance policy affords you coverage for loss of or damage to rental merchandise and the amount of the deductible you would pay under your policy.

CONDITIONS

REINSTATEMENT:  If Customer fails to make a timely payment, Customer may reinstate this agreement, without losing any of Customers rights or options by paying within (30)* days of Customer due date, (1) All past due rental charges, (2) If the property has been picked up, the reasonable costs of pickup and redelivery, (3) Any applicable late fees, and (4) Reinstatement fee of $5. Upon reinstatement Abode Home shall provide the Customer with the same property or substitute property of comparable quality and condition as determined by Abode Home. *(60 day for Iowa Residents, 90 days for Missouri Residents)

WARRANTIES:  Abode Home is not the manufacturer of the property provided under this agreement. Abode Home makes no warranties, expressed or implied, and assumes no liability for damages of any nature or kind to Customer, or to any person arising out of any use or connection with any of the rented item(s) or property.  No manufacturer warranties will transfer to the Customer should the Customer assume ownership of the property. 

MAINTENANCE:  During the period of this rental, Abode Home will provide service for the property, covering repairs due to normal wear & tear, at no additional charge to Customer. Abode Home will not be responsible for the costs of unauthorized repairs done by Customer or others. Abode Home will not be responsible for providing service to property damaged by Customer’s or others’ negligence.

USE OF FURNITURE: Customer agrees to use the property only at the original delivery address and agrees not to move the property without notifying Abode Home in advance. Provided a 10-day advance notice, Abode Home will move property within our service area and fees may apply. If Customer chooses to move the property themselves, they will be responsible for any damages incurred, and unauthorized move fees may apply. Property must remain inside our service area. Moves outside our service area must be approved in writing by Abode Home.

EARLY TERMINATION BY CUSTOMER: In the event the Customer ends the Item Rental Lease/Purchase agreement prior to fulfilling the term stated on the original Order Summary, Abode Home will provide an adjusted final payment amount and items will be returned to Abode Home.  The final payment amount will be calculated using the difference between Customer’s original rental term total and Customer’s actual rental term completed.  

TERMINATION AND DEFAULT:  Customer is not obligated in any way to renew this agreement or to buy the property.  Customer may terminate this agreement without penalty by voluntarily returning the property in good repair upon expiration of any rental term along with any past due rental payments and applicable Other Fees.  Customer agrees to pay rent until the property is returned to Abode Home or until the Customer acquires the property through the ownership options stated in this agreement. Abode Home may terminate this agreement if Customer fails to abide by the terms and conditions herein. Abode Home may notify Customer of termination in writing or verbally.

RETURN OF PROPERTY ON TERMINATION:  If this agreement is terminated for any reason, Customer agrees to make arrangements with Abode Home immediately for transfer of the property to Abode Home.  Customer agrees to pay Abode Home any rent and Other Fees that Customer owes when the property is returned.  CUSTOMER MUST GIVE ABODE HOME AT LEAST TEN (10) DAYS NOTICE TO SCHEDULE PICKUP BY ABODE HOME OR CUSTOMER MAY BE CHARGED FOR THE TEN (10) DAYS NOTICE. Original delivery charge includes final pickup by Abode Home’s truck. 

ASSIGNMENT:  Abode Home may sell, transfer, or assign this agreement. However, Customer has no right to sell, move, assign, pawn, or sub-lease this property without written consent of Abode Home. 

REIMBURSEMENT OF COSTS:  If Customer fails to abide by the terms and conditions of this agreement, in addition to other charges Customer may owe Abode Home, Customer understands that Customer will have to pay Abode Home for all reasonable costs Abode Home may incur in returning the property to Abode Home’s possession. These costs may include attorney’s fees and court costs if incurred and if permitted by state law.

MULTI-USE PROVISION: This agreement is intended for use in several jurisdictions. Customer agrees that if any of its provisions shall be held invalid or unenforceable under the laws of the state or jurisdiction in which Customer resides, the remaining provisions shall be enforced as if without the inclusion of the invalid term.

Customer understands that no changes may be made in this agreement except by Abode Home in writing.  

ENTIRE AGREEMENT:  The Order Summary and the terms and conditions contained in this agreement represent the entire agreement between Abode Home and Customer and supersede all prior agreements or understandings between Abode Home and Customer.  

NOTICE TO CONSUMER – READ BEFORE SIGNING” a. DO NOT SIGN THIS BEFORE YOU READ THE ENTIRE AGREEMENT, INCLUDING ANY WRITING ON THE REVERSE SIDE, EVEN IF OTHERWISE ADVISED. B. DO NOT SIGN THIS IF IT CONTAINS ANY BLANK SPACES. C. YOU ARE ENTITLED TO AN EXACT COPY OF ANY AGREEMENT YOU SIGN.

NOTICE TO IOWA RESIDENTS: YOU HAVE THE RIGHT TO EXERCISE ANY EARLY BUY-OUT OPTION AS PROVIDED IN THIS AGREEMENT. EXERCISE OF THIS OPTION MAY RESULT IN A REDUCTION OF YOUR TOTAL COST TO ACQUIRE OWNERSHIP UNDER THIS AGREEMENT. IF YOU ELECT TO MAKE WEEKLY RATHER THAN MONTHLY PAYMENTS AND EXERCISE YOUR PURCHASE OPTION, YOU MAY PAY MORE FOR THE LEASED PROPERTY.
